To patent an idea you need to begin with an Advanced Patent Search to establish any other inventions that are similar to your own. It will establish everything your patent application will be built upon and will establish the strength of your Utility or Design Patent in order to succeed.

 
 
 

The provisional patent is used in some cases to explore your options to patent an idea and its viability in the marketplace however you have only 12 months to decide whether you want to move forward with the actual patent process. If you do not decide after the 12 months you cannot patent any creation that matches your provisional application. The Utility Patent is based on the functionality of your invention and the claims made by the patented invention. The Design Patent is based on the ornamental appearance of the invention. This patent is strong only for the design and not necessarily for the Utility portion of the invention. In many cases both patents are preferred to give you the strongest position to challenge any future patent applications from gaining a similar patent.

 
 
 

 
 

The patent application process is a very important and sometimes misunderstood part of gaining a patent. To patent an idea or invention you must follow the MPEP established by the USPTO. The patent application itself is set to a format that is done only one way and if it is done incorrectly will be returned for correction or will be rejected and you will have to begin again including paying new filing fees.
